2. Eligibility and minors
- You must have legal capacity to enter this agreement or use the service with the involvement and valid consent of a parent or lawful guardian.
- Users under 18 may use eligible student-learning features only with parent or guardian consent where required. They may not use practitioner features.
- Practitioner features are restricted to adults who hold the qualifications, registrations, permissions, and professional authority required for their practice.
- We may request reasonable age, identity, qualification, or registration verification before granting or continuing access.
3. Accounts and security
You must provide accurate, current information; maintain only accounts you are authorised to use; protect your password, OTP, device, and recovery methods; and promptly notify us of suspected compromise. You are responsible for activity performed through your account to the extent permitted by law. Do not share a practitioner account or permit an unqualified person to use restricted features.
4. What HomoeoRx provides
HomoeoRx provides educational and practitioner-support software. Student tools may include a tutor, topic explanations, Organon, materia medica and repertory learning, comparisons, quizzes, notes, and learning history. Practitioner tools may include structured records, voice-assisted case taking, symptom extraction, follow-up questions, repertorisation, comparisons, differential analysis, documentation, timelines, and exports.
Features vary by plan, platform, region, device, professional verification, and release. The website and feature descriptions are informational; the checkout screen and current in-product plan description control the purchased entitlement.
5. Student educational-use restriction
HomoeoRx Scholar is for learning and self-assessment. Educational content does not confer a qualification, licence, registration, or authority to examine, diagnose, prescribe for, or treat another person. Students must not present educational output as professional medical advice or use it to delay licensed care.
6. Practitioner responsibilities
A practitioner using HomoeoRx Clinic agrees to:
- Use professional features only within their lawful qualifications, scope of practice, and registration.
- Obtain valid patient consent and authority before recording, uploading, transcribing, exporting, or sharing patient or case information.
- Conduct an appropriate independent history, examination, differential assessment, red-flag review, and referral process.
- Check source material, calculations, extracted symptoms, repertorial selections, remedy comparisons, and all AI-assisted output before use.
- Remain solely responsible for final diagnosis, prescription, remedy selection, potency, dose, repetition, monitoring, consent, documentation, referral, and emergency action.
- Maintain any independent clinical, consent, prescription, billing, or statutory records required by law or professional standards.
- Use suitable access controls and avoid displaying identifiable case information to unauthorised persons.
Chhayarani Technologies does not supervise the practitioner-patient relationship and does not become the treating practitioner merely by providing software.
7. AI limitations, no diagnosis, and no emergency use
AI, search, extraction, ranking, and comparison output can be incomplete, inaccurate, outdated, biased, unavailable, or unsuitable for an individual situation. HomoeoRx does not autonomously diagnose, prescribe, or determine emergency referral and does not guarantee a cure, clinical outcome, or treatment result.
HomoeoRx is not an emergency service. Do not use it to assess or delay urgent care for chest pain, breathing difficulty, unconsciousness, severe bleeding, stroke symptoms, suicidal thoughts, severe allergic reaction, pregnancy emergency, child emergency, or any serious or rapidly worsening condition. Contact local emergency services and obtain urgent in-person medical care.
Read the complete Medical Disclaimer8. User content, patient data, and permissions
You retain ownership of content you lawfully submit. You grant us and our contracted service providers a limited, non-exclusive permission to host, copy, transmit, process, format, secure, back up, and display that content only as needed to provide, protect, and support the service, comply with law, and exercise rights under these terms. This permission ends when the content is deleted from active systems, subject to backups and lawful retention.
You must have all rights, notices, consents, and professional authority needed for submitted content. Do not upload unlawful material, unrelated sensitive identifiers, Aadhaar numbers, passwords, OTPs, complete card details, malicious code, or information collected without authority. You are responsible for the accuracy and legality of your records.
9. Privacy and confidentiality
Our Privacy Policy explains our processing practices and available rights. You must use HomoeoRx consistently with confidentiality, privacy, consent, and recordkeeping duties that apply to you. Account deletion does not cancel an app-store subscription, and subscription cancellation does not automatically delete account data.
Read the Privacy Policy10. Plans, prices, taxes, and subscriptions
- The price, currency, tax, billing interval, trial terms, renewal terms, and included features are displayed before purchase through the applicable channel.
- A recurring subscription continues and the purchase channel may charge the selected payment method until renewal is cancelled through that channel.
- You authorise the applicable app store or payment provider to collect displayed charges and share transaction and entitlement status with us.
- Prices may change for future billing periods after notice through the service, purchase channel, or registered contact method as required by law. A price change does not retroactively alter a completed billing period.
- Promotional pricing, trials, institutional access, and coupons may have separate eligibility and expiry conditions disclosed with the offer.
- You are responsible for taxes or charges identified at checkout, except taxes imposed on our income.
11. Cancellation and refunds
Cancellation normally stops a future renewal and does not automatically refund the current period. Google Play and Apple purchases are managed through the corresponding store. A website payment, if enabled, is handled under the Refund and Cancellation Policy and applicable Indian consumer law. Nothing in these terms removes a statutory remedy for a deficient, misdescribed, or unavailable service.
Read the Refund and Cancellation Policy12. Third-party services and source material
Authentication, app stores, payments, cloud services, research links, and third-party publications may be governed by separate terms. We do not control an independent service and are not responsible for its availability or conduct. Third-party books, repertories, research, trademarks, and other materials remain subject to their respective rights, licences, limitations, and source quality.
13. HomoeoRx intellectual property
The HomoeoRx software, interface, brand, logo, original text, design, databases, workflows, and related intellectual property are owned by or licensed to Chhayarani Technologies Pvt. Ltd. Subject to these terms and payment where applicable, we grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the service for its intended educational or professional-support purpose. No source code, model, brand, or ownership right is transferred.
14. Acceptable-use rules
You must not:
- Use the service unlawfully, fraudulently, deceptively, or in a way that harms another person.
- Impersonate a practitioner, misstate credentials, evade verification, or give an unqualified person access to practitioner functions.
- Use output to make unsupported cure, guaranteed-result, disease-treatment, or emergency-care claims.
- Submit content without authority or violate privacy, confidentiality, intellectual-property, or contractual rights.
- Probe, bypass, disable, or interfere with security, authentication, rate limits, access restrictions, logging, or service availability.
- Reverse engineer, decompile, copy, frame, resell, scrape at scale, create a competing dataset, or automate access except where expressly permitted in writing or by non-waivable law.
- Upload malware, abusive content, unlawful content, or code intended to damage or monitor another system.
- Use the service or output to train or evaluate another commercial model without written permission.
15. Suspension and termination
We may restrict, suspend, or terminate access where reasonably necessary to address a material breach, non-payment, security risk, suspected fraud, unlawful use, professional verification failure, provider restriction, or legal requirement. Where appropriate, we will provide notice and a reasonable opportunity to respond. Immediate action may be taken to prevent harm or comply with law. Users may stop using the service and request account deletion, subject to payment, dispute, and retention obligations.
16. Service changes and availability
We may maintain, improve, add, replace, or discontinue features. We aim to provide reasonable notice where a change materially reduces a paid plan, except for urgent security, safety, legal, or provider changes. The service may be interrupted by maintenance, internet conditions, third-party systems, device compatibility, or events outside our reasonable control. Users should keep independent copies of essential professional records.
17. Disclaimers and limitation of liability
To the extent permitted by law, the service is provided on an "as available" basis without a promise of uninterrupted operation, error-free output, a particular educational result, clinical suitability, cure, or outcome. Users remain responsible for independent judgment, device and internet access, backups, and professional obligations.
To the maximum extent permitted by applicable law, neither party will be liable for indirect, incidental, special, or consequential loss that was not reasonably foreseeable. Our aggregate liability arising from a paid service will not exceed the fees paid by the affected user for that service during the 12 months before the event giving rise to the claim. This limitation does not apply where liability cannot lawfully be excluded or limited, including liability arising from fraud, wilful misconduct, gross negligence, or mandatory consumer rights.
18. Indemnity
To the extent permitted by law, an organisational user or practitioner will be responsible for third-party claims, losses, and reasonable costs arising from their unlawful use, unauthorised submission of patient data, breach of confidentiality, misrepresentation of credentials, or violation of another person's rights. This clause does not require a consumer to indemnify us for our own breach, negligence, or conduct for which we are legally responsible.
19. Force majeure
A party is not responsible for delay caused by events beyond reasonable control, including natural disaster, widespread network or cloud failure, war, civil disturbance, epidemic, government action, labour disruption, or power failure, provided reasonable steps are taken to reduce the effect. Payment already due and mandatory consumer remedies are not excused.
20. Governing law and dispute resolution
These terms and electronic transactions are governed by the laws of India, including applicable principles under the Indian Contract Act, 1872, Information Technology Act, 2000, Consumer Protection Act, 2019, and applicable rules. Before formal proceedings, the parties should first use the grievance process and make a good-faith effort to resolve the issue within 30 days.
Subject to a consumer's right to approach a consumer commission or other forum having jurisdiction under mandatory law, disputes are subject to the competent courts and tribunals having territorial jurisdiction in West Bengal, India. Nothing here restricts a non-waivable statutory remedy.
21. Changes, notices, and general terms
- We may update these terms prospectively. Material changes will be notified through an appropriate service or account channel and will show a revised effective date.
- If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary; the remaining terms continue.
- A failure to enforce a provision once is not a permanent waiver.
- You may not transfer an account or these terms without written permission. We may transfer this agreement as part of a lawful reorganisation or business transfer with appropriate notice.
- These terms, incorporated policies, plan details, and purchase disclosures form the agreement for the service and do not remove rights that cannot legally be waived.
- Electronic notices may be sent through the application, website, app store, or registered email or mobile contact.
22. Support and grievance redressal
Submit a complaint through the support form and retain the reference number shown after a successful submission. We aim to acknowledge consumer complaints within 48 hours and resolve them within one month, subject to their complexity and any information needed from the user.
